Democracy 3.0 is non-partisan and independent. We were established to promote the Common Good and we are committed to supporting campaigns that are consistent with our values:

  • We support campaigns promoting freedom of thought, expression and action.
  • We believe in the fundamental dignity of all humankind.
  • We believe in the family as the basic building block of society, in which the state should not interfere without good cause.
  • We recognise private enterprise, and particularly the role of small firms, as a force for good.
  • We believe in our duty to care for one another, especially the weak and vulnerable.
  • We believe in protecting the natural world and in treating the environment and other creatures with respect.
  • We want to encourage robust, evidence-based policy making.
  • We reserve the right to reject or remove campaigns which we consider not to align with these principles.

1. ACCEPTANCE OF TERMS OF USE

By signing up to create a campaign on our platform, signing to register as a supporter, commenting on a campaign, donating to a campaign, or ticking the box next to the words “I agree to the Terms of Use” on our platform, you signify that you accept these Terms of Use and agree to be bound by them.

2. CAMPAIGN CREATION

2.1 We reserve the right to remove any campaign which we judge to promote illegality, hatred, violence or discrimination based on race, gender, ethnicity, sexuality, disability, nationality or religion.

2.2 Campaigns may not explicitly promote political parties.  If you are a party candidate, employee or elected official and wish to create a campaign on our platform you must inform the Democracy 3.0 team.

2.3 We reserve the right to reject, edit or remove campaigns targeting individuals.

2.4 We reserve the right to reject, edit or remove any campaign which opposes Democracy 3.0, or opposes one of the campaigns that Democracy 3.0 is promoting on our platform.

2.5 It is essential that any claims made in your campaign must be factual and true. Ensuring factual accuracy is the responsibility of campaign creators and anyone posting comments onto the platform.  We reserve the right to remove or edit claims made by campaigns that are not supported by impartial evidence.

2.6 In order to create a campaign using our platform, you must first create an account. When creating your account, it is a requirement that the information provided about yourself is accurate and true.

2.7 Campaign creators and other account holders are solely responsible for maintaining the confidentiality and security of their account. They are also solely responsible for all activities conducted through their account.

2.8 Democracy 3.0 will not be liable for any loss or damage arising in connection with any unauthorised use of accounts.  Unauthorised uses must be notified to us immediately.

2.9 When campaign creators supply Democracy 3.0 with contact information (including email addresses and phone numbers), you consent to receiving messages (including by email, SMS and/or MMS):

(a) from the individuals and organisations who have signed your campaign;

(b) from us in relation to your campaign and other similar campaigns

(c) from trusted partners

2.10 You can unsubscribe from messages sent by any of the above at any time by clicking on the “unsubscribe” link at the bottom of our emails.

2.11 As a campaign creator you will not have direct access to the names and other personal information of the individuals signing your campaign.  However, we will communicate with your campaign supporters on your behalf with content and at intervals to be agreed between Democracy 3.0 and you.  Democracy 3.0 will not consent to using personal information for promoting political parties or candidates.

2.12 Democracy 3.0 is not liable for any action, claim, injury, loss or damage suffered or incurred relating to, or in connection with, any campaign created on our platform or any messages sent on behalf of users of our platform.

2.13 Democracy 3.0 is committed to providing a safe and respectful working environment for all our team. We reserve the right to close your account and/or your campaign if you are disrespectful, abusive or threatening to a member of Democracy 3.0 team. This includes, but is not limited to, behaviour such as making threats, shouting, nuisance calling and posting on social media accounts.

3. USE OF CAMPAIGN FUNDS

3.1 There is no charge for creating a campaign and publishing details on Democracy 3.0.  Below is a summary of charges deducted from campaign funds raised on the platform:

For all campaigns, payment processing costs are deducted from donations at the same rate as that levied by payment processing providers. Additionally:

Where total campaign funds raised are less than £10,000, Democracy 3.0 will deduct a flat fee of £500 from the total raised;

Where total campaign funds raised exceed £10,000, Democracy 3.0 will deduct 7% from the total raised. Democracy 3.0 reserves the right to vary deduction amounts but these will not be increased above 7%.

3.2 Payments are debited from donors immediately upon supporter authorisation.  Funds are held by Democracy 3.0 in a secure account pending the campaign close date.  Once closed, Democracy 3.0 will agree with the campaign creator a schedule to select, appoint and oversee professional campaign experts.  This process will be led by Democracy 3.0 in consultation with campaign creators.  The final decision and process to select, appoint and manage professional campaign experts will be made by the Democracy 3.0 Campaign Team.

3.3 An arrangement may be made whereby a Democracy 3.0 campaign can raise funds directly for a campaign being promoted through the Platform, where donations raised from that campaign can be paid directly to the Campaign Creator for disbursement at the absolute discretion of the Campaign Creator.  Where such an arrangement is made, the purpose of the funds being sought will be indicated on the Platform.

3.4 Where monies have been raised to cover legal costs, in the event that those monies are unspent, for example because of settlement or legal win, Democracy 3.0 reserves the right to reallocate surplus net funds to other similar cases.

4. SIGNING A CAMPAIGN

4.1 If you would like to sign to indicate your support for any campaign on our platform, you must provide us with information about yourself that is true, current and complete.

4.2 When campaign supporters supply Democracy 3.0 with contact information (including email addresses and phone numbers), you consent to receiving messages (including by email, SMS and/or MMS):

(a) from the individuals and organisations who have created campaigns you have supported;

(b) from us in relation to your campaign and other similar campaigns

(c) from trusted partners

4.3 You can unsubscribe from messages sent by any of the above at any time by clicking on the “unsubscribe” link at the bottom of our emails.

4.4 Democracy 3.0 is not liable for any action, claim, injury, loss or damage suffered or incurred relating to, or in connection with, any campaign created or supported on our platform or any messages sent on behalf of users of our platform.

5. CONTENT

5.1 When posting text, images and other content posted by you on our platform, you warrant that all such content is your original work and/or to the extent that it may include any text, images or other content owned by a third party, you warrant that you are licensed to use and reproduce such content on our platform.

5.2 You agree that we may, in our sole discretion and without notice, edit and/or remove any content posted on our platform which we believe violates these Terms of Use or which is or may be offensive, illegal, defamatory, or infringe the rights, or threaten the safety, of others.

5.3 By posting your content or any comment on our platform, you give Democracy 3.0 a perpetual, irrevocable, worldwide, royalty-free and non-exclusive licence to use, modify, reproduce, publish, broadcast, communicate, display and distribute your content in any format, using any medium, for the purpose of promoting your campaign.

5.4 Please contact Democracy 3.0 immediately about any inappropriate behaviour or inappropriate content on the platform.

5.5 We reserve the right to remove any user content for any reason. We will not do so lightly but ultimately any such decision is solely up to us to take.

6. USING OUR PLATFORM

6.1 Democracy 3.0 does not endorse or authorise any campaigns or publicly generated content on our platform.

6.2 Our platform must be used in accordance with these Terms of Use only for lawful purposes and in a way which does not infringe the rights of anyone or restrict or inhibit anyone’s use of our platform.

6.3 No personal information about other platform users may be collected for the purpose of sending unsolicited commercial messages or for any other purpose.

6.4 In order to enable necessary maintenance and updating of our platform we may need to suspend service, functionality or access to it from time to time, without notice. We will not be liable if, for any reason, our platform is not available at any time or for any period of time.

6.5 Democracy 3.0 owns, or is the licensee of, all intellectual property rights in the content of our platform, including text, photos, images and trademarks.

6.6 By using this platform you confirm that you are over 16 years of age.
We do not knowingly process data of any person under the age of 16. If we come to discover, or have reason to believe, that you are under 16, we will delete any personal information at the earliest opportunity and withhold our services accordingly.

6.7 Applicable law allows us to process personal information in emergency (i.e. life or death) situations including where it may be necessary to report it to relevant authorities.

7. LINKS TO THIRD PARTY SITES AND RESOURCES

7.1 Our platform contains links to third party sites and resources. We have no control over those sites, and will not be held liable for any loss or damage you suffer or incur when you use a third party site or resource.

7.2 We reserve the right to remove or edit campaigns, without notice if necessary, where we consider links to third party sites and resources to be inappropriate.

8. CLOSING YOUR ACCOUNT

8.1 We may suspend or cancel your account if you fail to comply with your obligations under these Terms of Use.

8.2 If your account is suspended or closed for any reason, you will not have access to the account including any content you may have posted.

8.3 The Democracy 3.0 staff team will determine, in its discretion, whether there has been a breach of these Terms of Use through your use of the platform. When a breach has occurred, we may take such action as we deem appropriate including but not limited to:

  • immediate, temporary or permanent withdrawal of your right to use the Democracy 3.0 platform;
  • immediate, temporary or permanent removal of any posting or content uploaded by you to the platform; or
  • legal proceedings against you for reimbursement of all costs on an indemnity basis resulting from the breach.

9. LIABILITY

9.1 You use the Democracy 3.0 platform at your sole risk.

9.2 We do not represent or warrant that the operation of our platform will be secure, confidential, uninterrupted, error-free, accurate, complete or current.  It is to be used on an ‘as-is’ basis.

9.3 The material and information made available on the Democracy 3.0 platform is provided without any guarantees, conditions or warranties as to its accuracy.

9.4 Except where we are unable to exclude our liability by law, we will not be liable to you for any loss or damage, however it arises, whether in contract, statute of tort (including negligence), arising out of, or in connection with, your use of (including inability to use) our platform.

9.5 We exclude liability for any loss of profit, loss or corruption of data, special, exemplary, punitive, incidental, indirect or consequential loss or damages suffered or incurred or arising in connection with our platform, or in connection with any act or omission by us (negligent or otherwise).

9.6 We are not liable to you for misuse of your information by other Democracy 3.0 members or third parties who gain access to the platform.

9.7 We are not responsible to you for any liability, actions, claim, injury, loss or damage you suffer or incur relating to or in connection with your participation in any activities organised or instigated by any campaigns on our platform.

10. INDEMNITY

10.1 You indemnify us against all liability, action, claim, loss or damage arising out of, or in connection with, your content, your use of (or inability to use) our platform, any breach of our Terms of Use, and your conduct with respect to our platform and other users of our platform.

11. USE OF OUR PLATFORM FROM OUTSIDE OF THE UK

11.1 While we welcome all visitors to this platform, we cannot guarantee that the platform is appropriate or available for use in any territory. Those who visit the platform from outside the UK are responsible for complying with all applicable laws. We cannot accept campaigns or donations from individuals or organisations in Cuba, Iran, Syria, North Korea, or the Crimea, Donetsk or Luhansk regions of Ukraine.

12. GENERAL TERMS

12.1 We reserve the right to change any of these Terms of Use, and/or add new Terms of Use at any time. Your continued use of our platform will be deemed to constitute your acceptance of such changes.

12.2 You must not publish or use for commercial purposes any part of the materials on the Democracy 3.0 platform without obtaining prior written consent from us.

12.3 If you are aware of any breach of these Terms of Use or other misuse of the Democracy 3.0 platform platform, please notify us immediately.

12.4 These Terms of Use set out the entire agreement between you and us relating to your use of our platform and supersedes all prior discussions and communications.

12.5   There is no relationship of agency, fiduciaries, partnership or employment between you and us.

12.6 These Terms of Use shall be governed and construed in accordance with the laws of England and Wales and any disputes relating to these Terms of Use shall be subject to the exclusive jurisdiction of the courts of England and Wales.

12.7 The Democracy 3.0 platform is owned and operated by Reclaim the Media Ltd., a company incorporated in England (No. 13562398).
